Defence Cover

FD&D (Freight, Demurrage and Defence) insurance covers a charterer in respect of legal costs and expenses in relation to pursuing or defending claims arising from contractual disputes. Our assureds benefit from legal assistance and advice from our team and also from external lawyers and suppliers.

Freight, Demurrage and Defence

The most common cases relate to disputes under the terms of a charterparty, but disputes arising under bills of lading or other forms of contracts of carriage approved by the Club are also covered. The Club has an experienced in-house team that helps to manage and advises clients on how to handle each case.

Cover is discretionary and is based on an assessment of the merits of the case. Where possible we will always look to settle on commercial terms but if a case needs to go to mediation, arbitration or litigation then this process is managed by the Club’s team. Shipping disputes are costly and time-consuming and the services of the Club in helping to manage these problems is invaluable to many of our assureds.

Up to USD 5 Million
FD&D COVER

We can provide a limit of liability up to USD 5 million for FD&D cover.

The deductible and policy terms are structured to suit the charterer’s individual needs.

1. Strike or Lockout (other than a Crew Strike)

Strikes can result in cash flow difficulties for an operator and may lead to a reduction in operating profits. Transmarine’s cover provides valuable financial protection for the daily costs arising from such an event which fall on owner or manager of a vessel.

2. Crew Strikes

We can also provide cover for charterers against delays caused by a strike of owners crew.

Claims Management

We have been assisting and handling claims exclusively for charterers since the 1980s. Our experienced team across three offices (London, Dubai and Shanghai) knows how to proactively manage claims and disputes so that charterers’ interests are always protected. We deal with a range of claims worldwide arising from marine casualties and incidents including cargo claims, unsafe port disputes, bunker quality issues and charterparty freight and demurrage claims and disputes.

 

The Charterers P&I Club has a global network of P&I correspondents that can assist our assureds in dealing with any claim or casualty. We have access to surveyors and maritime experts and professionals, who can be called upon when required depending on the nature of the matter. By way of illustration this could involve instructing an expert specialising in the carriage of a particular commodity or a fire expert who could advise as to the possible cause of a fire on board the vessel.
